1. Our statutory holiday pay calculation is based on Ontario Ministry of Labour: 4 weeks of earnings prior to the holiday divided by 20 (this is one statutory holiday, if there is 2 or more days, multiple the result by dates). see the reference link: http://www.labour.gov.on.ca/english/es/tools/disclaimer_php.php
The statutory holiday pay should be the same amount of regular pay, i.e., you pay one employee $100/day, the holiday pay must be = $100 with above fomular.
However, I have experienced some discrepancies on calculating part-time employees's pay. On my point of view, the above fomular is supposed to be used for full-time employees.
I.e., you have a part-time employee A, she works 2 days /week & gets pay $100/day; based on the above fomular, she will only get $40 for one stat. day pay instead of $100
I contacted Canadian Payroll Association, they provided the same formular, and they said the fomular is used for all types of employee, you can discuss with managers if you want to pay more.
2. I think there are 2 solutions:
1) As per CPA, use the fomular for all employees, since A is part-time employee, so her statutory holiday is also part-time (not sure whether there is a problem with common law)
2) Prorate it if you want to pay more for the part-time employees, and discuss with your boss.
不知道还有其它办法么?更多精彩文章及讨论,请光临枫下论坛 rolia.net
